YOU MAY BE A PATIENT, INDIVIDUAL, LAWYER, LAW FIRM, OR COMPANY WHO REQUESTED AND PAID FOR COPIES OF CERTAIN MEDICAL RECORDS FROM IOD INCORPORATED (NOW KNOWN AS DATAVANT LLC). YOU HAVE RIGHTS UNDER THE PROPOSED CLASS ACTION SETTLEMENT IF ARE A MEMBER OF THE FOLLOWING GROUP:

All patients, patient representatives, patient designees, including insurance companies and attorneys (including but not limited to, prosecuting, defense, or plaintiffs’ attorneys) designated by a patient or patients’ agents and representatives to obtain a patient’s medical records, who made a request or others who served a subpoena without being designated by a patient (“Record Requests”) to a Pennsylvania healthcare provider or facility to obtain copies of medical records and who were charged and paid to IOD Incorporated and or its subsidiaries the maximum basic, search and retrieval, and/or reproduction fees as set forth in 42 Pa.C.S. § 6152(a)(2)(i) of the Pennsylvania Medical Records Act as was effective between July 15, 2005 and September 3, 2012 with payment of the charges made between July 15, 2005 through September 3, 2012 and that was sent Mail Notice.

Your legal rights are affected whether you act or don’t act.  Read the notice carefully.

Your Legal Rights and Options in this Settlement:

 File a Claim

If you submit a Proof of Claim as explained in the Notice and that Proof of Claim is approved by the settlement administrator, you can recover 35% of the amounts you paid to IOD (now Datavant) in the form of basic fees, search and retrieval fees, and/or per page copying fees to obtain copies of medical records for such transactions between the time period 2005 to 2012.  Payments will be made if the Court approves the settlement after appeals are resolved (if any). The total amount of the amount you may recover is set forth on a Notice Of Class Action Settlement that was mailed to you if IOD/Datavant’s records showed that you are a class member.  If you did not receive this information, you may contact the Settlement Administrator

 Exclude Yourself

Receive no settlement payment.  This is the only option that allows you to ever be part of any other lawsuit against IOD/Datavant about the claims in this case.

 Object

Write to the Court if you disapprove of the settlement.

 Go to a Hearing

Ask to speak in Court about the fairness of the settlement.

 Do Nothing

Receive no settlement payment, and you will release any of your claims related to the claims in this case if the Court approves the settlement.
